Terms and conditions

1. Service purpose

Kidstoride is a cost-sharing platform between families to share rides to extracurricular and sports activities. The application is not a professional transport service nor a passenger transport company.

The driver offers spare seats in their own vehicle to other families, receiving in exchange a contribution to the trip costs. The platform calculates a maximum price using the formula (km × €/km) + (min × €/min), which the driver may not exceed.

1.bis Absence of profit-seeking — expense reimbursement

The contribution received by the driver has the exclusive nature of a reimbursement of the expenses incurred for a trip the driver was already going to make to take their own child to the activity. It does not constitute a price, professional consideration, or income from an economic activity.

To this end, the platform technically guarantees the absence of profit-seeking through the following binding mechanisms:

• Objective cap: the system prevents seats from being published at a price above the maximum calculated by the formula (km × €/km) + (min × €/min). Any attempt to exceed it is rejected by the server.
• Conservative parameters: the €/km and €/min values are set by the platform with reference to the actual average operating cost of a passenger car in Spain (fuel, maintenance, tyres, insurance and depreciation), never above the estimated real cost.
• Cost split, not price: the amount paid by each seat is the result of dividing a trip cost cap among the people sharing the trip, so the driver always assumes their proportional share of the cost and is never left in a position of net profit.
• Pre-existing vehicle and trip: when publishing seats, the driver declares that the trip is being made in any case for personal family reasons and that the vehicle is not used for an economic transport activity.
• No professional habituality: the platform does not allow the driver to perform the activity as a livelihood; the system is limited to trips connected to activities of children of the user, family group or association.
• Commission on the passenger contribution, not on the driver: the platform commission applies to the contribution paid by each passenger for the digital intermediation service; it never reduces the driver's expense reimbursement nor is it passed on as an additional cost to the driver.
• Individual tax responsibility: the compensation received by the driver may be subject to personal income tax rules. Art. 9 RIRPF sets 0.26 €/km as the reference for tax-exempt costs on private vehicle travel. On very short trips, the minimum seat price may result in per-kilometre compensation above this reference, in which case the excess could constitute a taxable capital gain in the driver's personal income tax return. Kidstoride acts exclusively as a technology intermediary and assumes no responsibility for the individual tax filings of its users; each driver must assess their own tax situation.

2. Registration and account

• You must be of legal age and have legal capacity to contract.
• Information provided at registration must be accurate and kept up to date.
• Each account is personal and non-transferable. The user is responsible for safeguarding their credentials.

3. Plans and payments

• Casual plan: free signup; charges are per ride.
• Family plan: monthly or annual subscription with N groups included. Additional groups are billed separately.
• Association plan: specific terms for clubs and entities.
• Payments are processed via Stripe. The user authorises recurring charges according to their plan.
• Amounts include the VAT applicable under current Spanish law.
• The platform fully covers the SEPA bank transfer fees applied to monthly payments to drivers. Drivers always receive the full amount of their expense reimbursement with no deduction for payment processing costs.

4. Cancellation and withdrawal

You may cancel the subscription at any time from your profile. Cancellation takes effect at the end of the current billing period; no refund applies for fees already accrued.

For subscriptions, under article 103.m of the Spanish Consumer Protection Act, the right of withdrawal does not apply once the service has started with the user's express consent. For annual subscriptions, withdrawal is 14 calendar days if the service has not started.

5. Driver obligations

• Hold a valid driving licence and the vehicle's mandatory insurance.
• Comply with traffic rules and child safety regulations (approved restraint systems).
• Not exceed the maximum price calculated by the cost-sharing formula.
• Not engage in professional paid transport activity through the platform.

5.bis User-uploaded content

Users may upload images (avatars, children's profile photos) and documents to the platform. By doing so, they declare that the content is lawful, does not infringe third-party rights and is appropriate for a family-oriented platform involving minors.

• It is prohibited to upload violent, sexual, discriminatory, illegal content or content that may harm the dignity or integrity of any person, especially minors.
• Images of minors may only be uploaded by their parent or legal guardian and are used exclusively to identify the child during trips.
• Any user may report inappropriate content through the platform's reporting system or by writing to privacidad@kidstoride.com.
• Kidstoride reserves the right to remove without prior notice any content that breaches these terms and to suspend or cancel the offending user's account.
• If content may constitute a criminal offence, particularly child sexual exploitation material, the platform will immediately notify the competent authorities in accordance with applicable law.

6. Limitation of liability

Kidstoride acts solely as a technology intermediary. It is not liable for users' acts, negligence or breaches during trips. Any incident, damage or accident is governed by the vehicle's insurance policies and applicable motor vehicle traffic legislation.

7. Suspension and termination

The operator may suspend or cancel accounts that breach these terms, applicable law or that put other users at risk.

8. Changes

These terms may be updated to reflect regulatory or functional changes. Changes will be communicated with reasonable notice and, for subscriptions, will not take effect until the next billing period.

9. Governing law and jurisdiction

These terms are governed by Spanish law. Any disputes shall be submitted to the courts of the consumer's domicile.

Payment and billing model

Kidstoride strictly separates two distinct economic concepts in each trip:

(A) Trip cost: this is the shared expense among families sharing the journey. This amount is NOT platform revenue, carries NO VAT and is NOT invoiced. It is an expense reimbursement between private individuals.

(B) App service fee: this is the price Kidstoride charges for its digital intermediation service. This amount IS platform revenue, carries VAT (21%) and IS invoiced.

Trip cost calculation

The total trip cost is calculated using the objective formula:

Cost = (distance in km × 0,26 €/km) + (duration in minutes × 0,00 €/min)

This cost is split among the actual number of passengers who complete the trip. The driver always assumes their proportional share.

The per-person price is an estimate until the trip completes. The final price is automatically adjusted based on actual passengers.

Service fee — public trips

For trips published as public (open to any family), Kidstoride applies a service fee on the per-person trip cost. This fee covers platform costs (development, support, infrastructure) and payment processing costs (Stripe).

The service fee is 10% of the per-person cost.

In all cases, a minimum service fee of 0,50 € per trip applies. If the percentage-based fee is lower than this minimum, the minimum is applied.

Service fee — group trips

For trips within a group (private, among members of the same entity), the service fee is lower, as the group already contributes through its subscription. This fee only covers payment processing costs.

The processing fee is 5% of the per-person cost.

The minimum service fee of 0,50 € per trip also applies to group trips.

VAT

VAT (21%) applies ONLY to the app service fee. The trip cost (shared expense between families) does NOT carry VAT, as it does not constitute a service provision or economic activity.

Invoicing and billing

Charges accumulate during the calendar month. At month-end, a single aggregated charge is made that includes:

• The sum of trip costs for the period (money transferred to the driver).
• The sum of service fees + VAT (21%) (platform revenue).
• Kidstoride issues a monthly invoice for service fees with a breakdown of taxable base and VAT. The trip cost does not appear on the invoice, as it is not platform revenue.

Driver payments

The driver receives 100% of their share of the trip cost, with no deductions whatsoever. The platform never deducts commissions, bank charges or any other amount from the driver's share.

Driver payments are made on a monthly aggregate basis, only after collecting from passengers. The platform never advances money to drivers.

Price transparency

Before confirming a booking, the user sees a full breakdown in three sections:

• Trip cost: estimated shared expense per leg (outbound and/or return), with no markup or profit.
• App usage: service fee + VAT (21%).
• Estimated total: sum of both concepts.
• The final price adjusts when the trip completes based on the actual number of passengers.
